Insolvency

If you have a claim against a company in insolvency or need advice for the debtor, we help you understand your legal position and the steps available in the proceedings. We review supporting records, creditor lists and applications already filed to prepare a proof of claim, a challenge or representation in a dispute. Our engagement concerns legal assistance for a party, separate from the duties of an insolvency practitioner or court-appointed administrator.

Situations we can help with

  • You have a claim against a company involved in insolvency proceedings.
  • You need advice for the debtor company, have received procedural documents or want to discuss an entry in a creditor list.

Legal services

  • Review of documents supporting a debt and preparation of a proof of claim.
  • Examination of creditor lists and grounds for a possible challenge.
  • Assistance concerning a debtor’s legal position and applications made in the proceedings.
  • Representation in related disputes and review of documents communicated to participants.

From consultation to the next steps

  1. The case and your role

We identify the company, proceedings and whether you seek assistance for a creditor or the debtor. For the debtor company, explain who represents it and which application or procedural document needs review.

  2. The claim’s position

We review the outstanding balance alongside supporting records and procedural documents.

  3. Steps already taken

We discuss filed applications, replies received and the specific assistance needed.

What to prepare for your consultation

  • Identify the company, case number and published or served procedural documents you hold.
  • Reconstruct the balance from contracts, invoices, payments and security documents, separating disputed amounts.
  • Mention whether the claim has already been filed and what response or entry appears in the creditor list.

Frequently asked questions

Which records should I prepare for a claim?

Contracts, invoices, payment records and available security documents, alongside procedural records. Show principal, ancillary amounts and disputed sums separately.

What if I have already filed an application?

State when and where it was filed, identify proof of filing and describe the reply or creditor-list entry you know about. If you seek assistance for the debtor, also prepare applications concerning the company, documents served and a timeline of steps already taken.

Do you act as the court-appointed administrator?

No. We provide legal advice and representation for you as a party to the proceedings. The duties of an insolvency practitioner or court-appointed administrator are separate from this engagement.

Discuss your matter with a lawyer

A consultation helps identify the documents to review and the matters for which you seek assistance. Give a brief outline, then discuss the details directly with the lawyer.

The scope of assistance, fees and working arrangements are agreed before the engagement is confirmed.
